These Terms of Service (“Terms”) govern access to SyncPoint Media websites, client portals, streaming services, and related products operated by SyncPoint Media (“SyncPoint,” “we,” “us”). By creating an account, completing checkout, or using our services, you agree to these Terms. Music Pack downloads are also subject to the separate Music Pack License.
1. Who may use SyncPoint
Our services are intended for businesses and organizations (restaurants, churches, retail, offices, and similar venues). You represent that you have authority to bind the business named at signup and that information you provide is accurate.
2. One-location license
Unless you purchase additional site licenses or a multi-location arrangement confirmed in writing, each streaming subscription covers one physical business location. Playing the stream at additional locations requires additional licenses. Sharing your player link publicly, or using it outside the licensed location’s normal operations, is not permitted.
3. Streaming service
- We provide curated commercial background music via a secure web player / stream URL.
- Genre options and features depend on your plan (e.g. Core shared stations vs Pro dedicated station and Promo Studio).
- Service availability depends on your internet connection and compatible playback devices.
- We may update station lineups, player software, or infrastructure to maintain quality and rights compliance.
4. Accounts and security
You are responsible for safeguarding portal login credentials and stream URLs. Notify us promptly at [email protected] if you suspect unauthorized access. We may suspend access to protect the service or rights holders.
5. Billing
Subscription fees are billed through our payment provider (currently PayPal) on the schedule shown at checkout (monthly or annual). Prices are listed in USD unless stated otherwise. Failed payments may result in suspension until resolved. Taxes may apply where required by law.
6. Acceptable use
You agree not to:
- Redistribute, rebroadcast, or resell SyncPoint streams or files
- Attempt to bypass IP allowlists, tokens, or other access controls
- Use SyncPoint music in ads, films, apps, or products beyond background venue playback without written permission
- Interfere with other customers’ stations or our infrastructure
7. Intellectual property
SyncPoint branding, site content, player software, and the curated programming remain our property or that of our licensors. Your purchase grants a limited license to use the service as described — not ownership of the underlying music copyrights.
8. Disclaimers
Services are provided “as is.” We do not warrant uninterrupted uptime. SyncPoint licensing covers SyncPoint-provided music for the uses described in our Licensing page; it does not cover third-party music sources you choose separately.
9. Limitation of liability
To the fullest extent permitted by law, SyncPoint’s total liability arising from these Terms or the service is limited to the amounts you paid us for the service in the three (3) months before the claim. We are not liable for indirect, incidental, or consequential damages (including lost profits or PRO claims related to non-SyncPoint music).
10. Cancellation
You may cancel a subscription by contacting support. Cancellation stops future renewals; access continues through the end of the paid period unless otherwise stated. See our Refund Policy.
10a. Pause (temporary hold)
Instead of canceling, you may request a temporary pause of 60 or 90 days, once per 365 days, by emailing [email protected]. Pauses are applied by SyncPoint admin staff. While paused, billing and stream access stop; resume uses the same PayPal subscription (no new purchase). Details: Refund Policy — Subscription pause.
11. Changes
We may update these Terms by posting a revised version on this page with a new effective date. Continued use after changes constitutes acceptance of the updated Terms.
