What to Do Next"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">A BMI demand letter or ASCAP demand letter is usually a licensing demand backed by a file \u2014 investigator notes, calls, songs listed. It is not the same thing as a judgment. Ottobar in Baltimore is what the file looks like after years of outreach and a karaoke night the venue thought was already covered.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On June 23, 2026, a federal magistrate ordered Ottobar to pay about <strong>$12,048.75<\/strong> in statutory damages (the Daily Record\u2019s wording: \u201cslightly over $12,000\u201d) plus <strong>$6,500<\/strong> in attorney\u2019s fees to <strong>BMI<\/strong> and three publishers (Sony Music Publishing, EMI Blackwood Music, and All Clear Music). <em>The Daily Record<\/em> (25 June 2026) headlined it at <strong>$18.5K<\/strong>. <em>The Banner<\/em> wrote \u201cover $18,000.\u201d It was not a background-stream case. BMI sued over three <strong>karaoke<\/strong> songs: \u201cTake On Me,\u201d \u201c(I Just) Died in Your Arms,\u201d and \u201cGoodbye Earl.\u201d The venue conceded liability. Magistrate Judge J. Mark Coulson entered a permanent injunction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Owner Tecla Tesnau told <em>The Banner<\/em>: \u201cWe have licensing agreements with other agencies, and I mistakenly thought that we were completely covered. \u2026 That was incorrect.\u201d BMI told the court it had reached out more than 30 times since 2023.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is BMI demand letter  path, taken all the way to a judgment. Most owners who get mail are earlier in the same path.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>We are not a law firm and do not provide legal advice.<\/strong> If you mix SyncPoint with other music sources, talk with your counsel or the relevant PRO about those other sources.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What the letter usually is<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Performing rights organizations license the public performance of the songs they represent. The New Mexico Restaurant Association names <strong>five<\/strong> U.S. PROs: <strong>ALLTRACK, ASCAP, BMI, SESAC, and GMR<\/strong>. Each represents a different catalog. A license from one is not a license from the others.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">BMI\u2019s own FAQ says the same thing. A license from another PRO covers that PRO\u2019s catalog only. It does not cover BMI\u2019s. Spotify, Pandora, and Apple Music subscriptions do not provide the clearance to play those songs in a public setting:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">Although your digital music subscription gives you access to an enormous catalog of music, it does not provide the necessary copyright clearance to play those songs in a public setting. Once you decide to play any copyrighted music publicly, you need permission from the copyright owners.<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The venue owner \u2014 not the DJ, the band, or the karaoke host \u2014 is the one BMI licenses.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">NMRA\u2019s FAQ on \u201cI received an email, call, or letter from a PRO\u201d is blunt: \u201cMost likely, yes.\u201d Licensing is almost always cheaper than ignoring the file.<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"559\" src=\"https:\/\/syncpoint.media\/blog\/wp-content\/uploads\/2026\/09\/ascap001.jpg\" alt=\"ASCAP or BMI Demand Letter\" class=\"wp-image-132\" srcset=\"https:\/\/syncpoint.media\/blog\/wp-content\/uploads\/2026\/09\/ascap001.jpg 1024w, https:\/\/syncpoint.media\/blog\/wp-content\/uploads\/2026\/09\/ascap001-300x164.jpg 300w, https:\/\/syncpoint.media\/blog\/wp-content\/uploads\/2026\/09\/ascap001-768x419.jpg 768w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">How the letter usually gets written (the pattern commercial-music vendors describe \u2014 including CloudCover\u2019s mail guide \u2014 not a clone of anyone\u2019s sample reply):<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Outreach first \u2014 mail, email, phone.<\/li>\n\n\n\n<li>An investigator visit. Agents walk in, listen, and log songs.<\/li>\n\n\n\n<li>A demand that names a catalog, sometimes specific titles and dates, and a response window.<\/li>\n\n\n\n<li>Follow-ups if nothing changes. Then, in some cases, a federal complaint.<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">Custom Channels hears the same owner sentence: \u201cWe got a letter, and we were confused. We just play music off the iPad behind the counter.\u201d That iPad is often a personal Spotify account on the house speakers. Personal accounts are licensed for private listening. We already covered that in <a href=\"https:\/\/syncpoint.media\/blog\/is-spotify-legal-for-business\/\">Spotify for business<\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Karaoke is not a background stream<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Ottobar\u2019s three songs were karaoke in Otto Upstairs. That matters for two reasons.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">First, a background-music account is not a karaoke license. CloudCover\u2019s own letter kit says the steps they outline apply to background music played through their service \u2014 not live, not karaoke. NMRA: a background service never covers live bands, singers, DJs, TVs, karaoke, jukeboxes, or consumer apps. If any of those show up during the year, the venue still has a separate conversation with the PROs.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Second, SyncPoint does not cover karaoke, live bands, or DJs spinning other catalogs. <a href=\"https:\/\/syncpoint.media\/licensing\">Licensing<\/a> (effective July 21, 2026) lists those as out, next to personal Spotify, YouTube, and extra locations. <strong>A SyncPoint stream or Music Pack would not have covered Ottobar\u2019s three karaoke titles.<\/strong> Do not read a background subscription as a blanket for every speaker in the building.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The same split shows up in older cases, with different facts:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Vazzy\u2019s Cucina (Shelton, CT, 2014):<\/strong> $18,000 BMI settlement over nine songs. Hartford Business reported the owner thought Muzak, cable, or a private party covered him. Afterward he bought a BMI license for about $4,500 a year.<\/li>\n\n\n\n<li><strong>The Pirate\u2019s Den (Green Township, OH, 2016):<\/strong> ASCAP filed a suit that <strong>seeks up to $90,000<\/strong>. Cincinnati.com did not report a paid $90,000. The owner said he already had a BMI license. One song named in coverage was Michael Jackson\u2019s \u201cRock With You.\u201d<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">One PRO, a cable feed, or \u201cwe license with other agencies\u201d is how Tesnau, Vazzy\u2019s, and Pirate\u2019s Den all described the gap. BMI\u2019s FAQ is the short version: another PRO\u2019s license is not enough.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">More on those three files, with the live-page corrections: <a href=\"https:\/\/syncpoint.media\/blog\/5-hidden-costs-of-licensed-music-for-business\/\">hidden costs of licensed music<\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What to do when the letter arrives<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is operational, not legal advice. The letter is their document. Your job is to know what actually plays in the room.<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Read it once for facts.<\/strong> Which PRO. Which location. Any song titles or dates. The response date they printed. Put the envelope with the invoices, not in the junk drawer.<\/li>\n\n\n\n<li><strong>Do not ignore the follow-ups.<\/strong> Ottobar\u2019s file had more than 30 BMI contacts since 2023 before the June 23, 2026 order. A letter is earlier than a complaint. Silence is how it stops being a letter.<\/li>\n\n\n\n<li><strong>Inventory every music source in the building.<\/strong> House background stream. Staff phones on aux. TVs with audible music. Karaoke laptop. Live band or DJ. Hold music. Patio speakers on a different input. Write down the device and the account, not \u201cwe just play music.\u201d<\/li>\n\n\n\n<li><strong>Split background from everything else.<\/strong> A commercial background service \u2014 including SyncPoint \u2014 speaks to its own catalog in the licensed room. Karaoke of third-party songs, live covers, and DJs of other catalogs sit outside that. So does a personal Spotify account on the floor speakers.<\/li>\n\n\n\n<li><strong>Pull proof for the sources you already license.<\/strong> Invoices. The license or subscription page. The player URL. Vendors who deal with these letters say PRO agents understand invoices. That is documentation, not a courtroom strategy. Do not paste someone else\u2019s sample reply as yours.<\/li>\n\n\n\n<li><strong>Match the letter to the source.<\/strong> If the songs listed were karaoke, a background-stream invoice will not answer the claim. If they were the house stream and that stream is a licensed commercial service, the invoice is the relevant page. If they were a staff phone, say so internally so you can stop that source.<\/li>\n\n\n\n<li><strong>Talk with counsel if sources are mixed, or if the paper is already a lawsuit.<\/strong> We are not a law firm and do not provide legal advice.<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">Statutory damages under 17 U.S.C. \u00a7 504(c) are commonly described as $750 to $30,000 per work, and up to $150,000 if willful. Those are the ranges PROs cite. Read it. Inventory the room. Separate karaoke and live from the background stream. BMI is clear that Spotify does not clear public performance and that one PRO is not the others.
